Capable, compassionate and inclusive leaders

The provider had recently taken on a number of care workers from other service providers in the area. They were transferred under the Transfer of Undertakings (Protection of Employment Regulations) 2006 legislation. (TUPE) Which protects the employee’s benefits when their employment changes hands from one company to another. The provider had failed to complete checks on the staff transferred to ensure new care workers were complaint with schedule 3, Fit and Proper Person Requirements. The registered manager had failed to send CQC notifications for 2 incidents which were deemed to be notifiable. The local authority had been notified of these incidents an action had been taken to safeguard people, and minimise the risk of repetition. The registered manager has since completed the notifications and sent them into CQC.
