High Court dismisses challenge to publication of report on Inadequate care home

The Care Quality Commission has published a report on Ashworth Grange care home at Dewsbury in West Yorkshire.

During an inspection in September 2017, CQC found that the provider was failing to provide care as required by regulations. The service was rated Inadequate.

At the High Court on Friday, the provider, Ideal Carehomes (Number One) Limited, applied for an injunction to prevent CQC publishing the report. The judge refused the application, awarding CQC full costs of over £15,000.

The report has now been published on our website.

Debbie Westhead, Deputy Chief Inspector of Adult Social Care, said:

“It is our duty to ensure that health and social care services provide people with safe, effective, compassionate, high-quality care."

“People have the right to know the quality of care they are receiving – in this case a service that was Inadequate. We have a statutory responsibility to publish the reports of our inspection, as confirmed by the High Court in this case."

“Our inspection found that Ideal Carehomes (Number One) Limited has continued to let down the people in its care, and must improve."

“In the meantime we will monitor Ashworth Grange and work closely with Kirklees Council to ensure that people are safe from harm.”
